BANFF – Countries like Canada and Switzerland have coined the phrase “The Netflix Law” – what we formally refer to as Bill C-11 these days.
Few companies have earned such an international legal meme. Indeed, Netflix is perhaps the definitive media entity of the 21st century.
At the 2022 Banff World Media Festival (BWMF) a riveting Summit Series featured Bela Bajaria (above, left), head of global TV for Netflix, moderated by Nekesa Mumbi Moody (right) of The Hollywood Reporter.
Netflix was the first steamer to…

BANFF – Diversity and representation were core themes at the 2022 Banff World Media Festival (BWMF).
So, when it comes to crucial data, the session Being Counted: Canada’s First Race-based Audience Survey Signals Market Opportunities & Data Collection Gaps, was pivotal.
Sure, it’s a lot of words for the title of a panel but perhaps it comes down to one delegate’s frank remark: “Sit down white people and let us lead!”
Speakers included Adam Garnet Jones (above, top left), director of TV content and special events at APTN, Lea Marin (top…

BANFF – Few aspects, if any in the entertainment industry, are more important than the carving up of rights and intellectual property.
It is a minefield for the layperson, with every license ideally carefully defined – even in the case of a sales deal where there is no grant of rights to the agent, careful detailing of which rights an agent can sell on behalf of an IP owner requires strict clarity.
This includes term, territory, language, sub-licensing and assignment and more. Other than being the price of democracy, this is why our business needs lawyers.
In the Banff World…

OTTAWA – The federal government today introduced Bill C-26, An Act Respecting Cyber Security (ARCS), which proposes amendments to the Telecommunications Act.
On May 19, when François-Philippe Champagne, the minister of Innovation, Science and Industry, made the announcement that the Canadian government intended to prohibit the inclusion of Huawei and ZTE products and services in Canada’s telecommunications systems, he mentioned legislative changes were coming.
“We intend to introduce amendments to the Telecommunications Act (TA) to ensure that promoting the security and protection of our telecommunications system is an overriding objective of Canada’s telecommunications policy,” the policy…

BANFF – Today the Banff World Media Festival (BWMF) featured a brief, whistle-stop appearance by Pablo Rodriguez (above), minister of Canadian Heritage.
Valerie Creighton, president and CEO of the Canada Media Fund, and a strong advocate for Bill C-11, The Online Streaming Act, provided his introduction – but not before extolling “the stellar job” done by BWMF staff in organizing the in-person event and breaking out into several bars of delightful song!
It appeared to me to be a riff on the old Frank Sinatra Summer Wind, but with revamped lyrics appealing to the promise and possibilities of getting…

OTTAWA – Minister of Innovation, Science and Industry, François-Philippe Champagne, last week announced the launch of a consultation on a policy and licensing framework for the auction of spectrum licences in the 26, 28 and 38 GHz bands, which are key for 5G wireless networks.
The government is making “large amounts of high-frequency spectrum available to encourage the effective deployment of 5G technologies,” according to a press release.
The mmWave Licensing Framework Consultation seeks comments on several proposed measures intended to promote competition and foster innovation – as well as ensure spectrum is used by service providers in a timely…

BANFF – From touchdown at Calgary International Airport, there were strong hints that this is going to be a different Banff World Media Festival (BWMF).
Climbing aboard the Banff Airporter transit to head into the Rockies, the group chatter was not about who won at the Sundance Film Festival or who had landed a Netflix series deal – it was entirely about upbeat Black, Indigenous, People of Colour (BIPOC) collaboration, building positive relationships, and to quote one Canadian 30-something producer on our bus, now living in Los Angeles, “literally decolonizing Hollywood”.
After two years of delivering the BWMF online…
