CRTC asks Lixo for info after Rogers reports it’s still being denied access to 70 Yorkville Avenue


OTTAWA – The CRTC has sent Lixo Investments a request for information regarding claims from Rogers Communications it is refusing to grant the telecom access to 70 Yorkville Avenue in Toronto despite the Commission having issued a decision on June 8 granting the telecom’s request for access.

The Commission’s decision indicated increasingly stringent measures would take effect 30 and 45 days from the date of the decision if Rogers did not report it had “been granted timely access under reasonable terms and conditions.”

At issue is Rogers ability to access the building to service facilities installed in the 1980s. Rogers indicated in its application seeking to be granted access to 70 Yorkville Avenue “that it installed facilities and began providing telecommunications services in 1984,” the CRTC’s decision on the matter says.

Rogers and Lixo confirmed they do not have a building access agreement, with Lixo further claiming it has no knowledge of Rogers’ facilities installed in the building, according to the decision.

The CRTC’s letter to Lixo says Rogers reported on July 8 and July 22 that its attempts “to engage Lixo in negotiations to reach an access settlement agreement have been unsuccessful and it remains unable to gain access to 70 Yorkville Avenue to the extent outlined within the Decision.”

As of July 8, “any LECs (local exchange carriers) and carrier ISPs, which are already providing services to residential, retail, and commercial occupants of 70 Yorkville Avenue via copper wire and fibre,” cannot provide services to new occupants, provide services to occupants who are not already a customer or modify or upgrade services other than cancelling services, according to the CRTC’s letter.

The CRTC notes it may now take further action including having all LECs and carrier ISPs discontinue providing telecommunications services at the building.

Lixo must respond to the CRTC’s request for information by Aug. 18.
