TORONTO — Look Communications Inc. and Bell Canada have put their spat on hold, and have agreed to extend the May 10 deadline for Bell to disconnect the services it provides to Look.
The two companies have agreed to the following:
1. Bell will not disconnect services provided to Look pending the decision of the CRTC;
2. Once the decision of the CRTC is issued, Bell will not suspend services to Look for five business days from the date of the CRTC decision;
3. Look will provide Bell with its notice of motion for an injunction and supporting affidavit by May 10, 2007; and
4. The agreement is without prejudice to Bell’s ability to make any argument in the injunction motion, action or other forum.
Look said in a statement that it remains committed to ensuring the continuation of its services to its 60,000 subscribers and fully intends to pursue all regulatory and legal remedies available.
Look filed a part VII application on April 27 with the CRTC asking for an order requiring Bell to comply with its terms of service under section 24 of the Telecommunications Act. The action in response to Bell’s notice of intent to disconnect Look’s services effective 30 days from April 10. Look’s claim alleged numerous breaches of contract, misrepresentations and abusive behaviour by Bell Canada.
Look owns about 100MHz of licensed contiguous spectrum, which it says is “highly valuable and coveted by interested parties.”
